By using the DACOS website (dacos.dental), the DACOS online store, DACademy platform, or any services provided by Metadac FZE, you agree to comply with and be bound by the following Terms & Conditions. Please read them carefully before using our site or purchasing any products.

1. Eligibility

By accessing our website and services, you confirm that:

• You are at least 18 years old, or you have the legal authority to agree to these terms on behalf of a company or organization.

• You agree to use the site only for lawful purposes and in compliance with all applicable laws and regulations.

2. Intellectual Property

2.1 General Content

All content on this website and related platforms, including text, images, product designs, product photography, graphics, logos, instructional materials, video content, and user interface designs, is the property of Metadac FZE or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or commercially exploit any content without prior written consent from Metadac FZE.

2.2 Trademarks

The following are trademarks or registered trademarks of Metadac FZE:

• DACOS®

• DACOS Omni™

• ZeroDrift™

• TrueContact™

• ShieldBase™

• DockingMatrix™

• TrueZero™

• DACademy™

• StepLock™

Use of these marks without written authorization is strictly prohibited.

2.3 Patent Protection

The DACOS Omni system, including its adapter plates, calibration method, attachment geometry, and magnet placement tools, is protected by pending international patent application PCT. Unauthorized reproduction, manufacture, or distribution of any component covered by this application is prohibited and may result in legal action.

3. Software, Libraries & Digital Files

3.1 License Grant

Upon valid purchase of a DACOS Omni product, Metadac FZE grants the customer a limited, non-exclusive, non-transferable, revocable license to use the associated digital files (including but not limited to CAD libraries, attachment libraries, plate libraries, Gemini Calibrator STL files, offset tester files, and any other downloadable content provided through DACademy or other official distribution channels) solely for the customer’s own internal laboratory production use, in connection with the purchased DACOS Omni hardware.

3.2 Prohibited Uses

The following actions are expressly prohibited without prior written consent from Metadac FZE:

• Distributing, sharing, uploading, forwarding, or otherwise making available any DACOS digital files to any third party, whether for commercial or non-commercial purposes.

• Posting DACOS files on any file-sharing platform, forum, cloud storage service, social media, or peer-to-peer network.

• Reselling, sublicensing, or bundling DACOS digital files with any other product or service.

• Providing DACOS files to competing manufacturers, resellers, or any entity not authorized by Metadac FZE.

3.3 Reverse Engineering & Geometry Protection

The DACOS Omni system includes proprietary geometries, attachment designs, socket configurations, calibration references, and mechanical interfaces that are the result of significant research, development, and investment by Metadac FZE. These geometries are protected by intellectual property rights, including but not limited to the Hague design registration and pending patent PCT.

The following are strictly prohibited:

• Reverse engineering, decompiling, disassembling, measuring, scanning, or otherwise analyzing the STL files, CAD libraries, or physical components of the DACOS Omni system for the purpose of replicating, reproducing, or deriving equivalent or substantially similar geometries, designs, or systems.

• Using any DACOS digital file, including STL geometry data, as a reference, template, or basis to create competing or derivative products.

• Extracting dimensional data, tolerances, offset specifications, socket geometry, or calibration references from DACOS files to develop any product or system not authorized by Metadac FZE.

• Manufacturing, 3D printing, or producing any physical component that incorporates or is substantially derived from DACOS proprietary geometry without written authorization.

Any violation of this section constitutes a material breach of these Terms and may result in immediate license termination, injunctive relief, and pursuit of all available legal remedies including damages.

3.4 Third-Party CAD Software

Unless clearly stated otherwise on the product page:

• DACOS hardware kits and components do not include any CAD or CAM software licenses (e.g., Exocad, 3Shape, Blender for Dental).

• DACOS libraries for supported software platforms are distributed separately by Metadac FZE or its authorized partners.

• Availability, pricing, and distribution methods for software libraries may differ by platform and region.

3.5 DACademy Platform Access

Access to DACademy (dacademy.ai) is provided as part of the DACOS Omni purchase and is subject to separate platform terms. DACademy accounts are non-transferable and are tied to the email address used at the time of purchase. Content, tutorials, and educational materials available on DACademy are proprietary to Metadac FZE and subject to the same intellectual property protections described in Section 2.

3.6 License Termination

Metadac FZE reserves the right to revoke the digital file license and suspend DACademy access immediately and without notice if a customer is found to be in violation of any provision of this Section 3. Upon termination, the customer must destroy all copies of DACOS digital files in their possession.

4. User Content

If you submit content to us (such as reviews, feedback, testimonials, or case images), you grant Metadac FZE a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content for promotional or operational purposes.

You are responsible for ensuring that any content you submit does not infringe the rights of third parties.

5. Product Information, Availability & Specifications

We strive to provide accurate and up-to-date product information. However:

• Availability, pricing, and specifications may change without prior notice.

• DACOS cannot guarantee that colors, sizes, or product visuals on the site perfectly represent the final product due to screen and rendering differences.

• Minor visual or cosmetic variations that do not affect function are not considered defects.

6. Shipping, Customs & Duties

6.1 Shipping Origin

All orders are shipped from the United Arab Emirates or EU Hub using third-party carriers such as FedEx, DHL or similar services.

6.2 Duties, Taxes, and Customs Fees

For international deliveries (including EU, US, and other regions):

• Local VAT, import duties, customs clearance fees, and handling fees may be charged by the carrier or customs authority in the destination country.

• Unless explicitly stated as “Duties & Taxes Included” at checkout, these charges are not included in the price you pay on dacos.dental and are the responsibility of the receiver.

• We cannot predict or control the exact amount of these charges, as they are determined by local authorities and carrier policies.

Placing an order on dacos.dental constitutes acceptance of this condition.

6.3 Shipping Times

Estimated delivery windows shown at checkout are indicative only and may vary due to customs delays, carrier issues, or other factors beyond our control. Metadac FZE is not liable for delays caused by carriers, customs, or force majeure events.

7. Disclaimer of Warranties

Our website, services, and products are provided “as is” without any guarantees or warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

While we make every effort to maintain accurate information and stable operations, we do not warrant that:

• The website will be error-free, uninterrupted, or free from security vulnerabilities; or

• The information on the site will always be complete, current, or accurate.

8. Limitation of Liability

To the maximum extent permitted by law:

• Metadac FZE shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the website, products, digital files, or services, including but not limited to loss of data, revenue, or profits.

• Our total liability for any claim related to a purchase from dacos.dental shall not exceed the amount you paid for the specific order giving rise to the claim.

• Nothing in these Terms limits liability that cannot be excluded under applicable law.

9. Third-Party Links

Our website may contain links to third-party websites or services. These are provided for convenience only. Metadac FZE does not endorse and is not responsible for the content, products, services, or practices of those external sites.

10. Termination of Access

We reserve the right to suspend or terminate your access to dacos.dental, DACademy, and any associated services, without prior notice, if:

• You violate these Terms & Conditions;

• You violate the software and digital file license terms in Section 3;

• You engage in fraudulent or abusive behavior; or

• Your actions are reasonably considered harmful to our business, reputation, intellectual property, or users.

11. Returns, Refunds & Accuracy Guarantee

DACOS Omni products are precision-engineered medical-laboratory devices. Because they integrate into clinical and laboratory workflows where outcomes depend on user-controlled variables (3D printer, articulator condition, resin, calibration discipline), we operate two distinct refund regimes — described below. This Section 11 sets out the exclusive remedies available to the Buyer in connection with returns and refunds.

11.1 Standard Returns (Damaged, Defective, or Wrong Item)

A standard return may be approved if, on delivery, the product:

• Arrived physically damaged due to shipping;

• Was the wrong SKU shipped in error by Metadac FZE; or

• Was demonstrably defective in materials or workmanship prior to use.

Mandatory conditions:

• Report to info@dacos.dental within 7 calendar days of delivery confirmation;

• Include order number, high-resolution photographs of (a) the defect and (b) the original packaging as received;

• Do not assemble, install magnets, apply adhesives, or otherwise prepare the product for use until the return is authorized;

• Once authorized, ship back within 5 business days using the carrier method we specify.

Products that have been used, assembled with magnets or adhesives, exposed to resin or chemicals, or modified in any way are not eligible for standard return.

11.2 TrueZero™ Accuracy Guarantee

Separately from Section 11.1, Metadac FZE warrants that the DACOS Omni system, when used in accordance with our published procedures and within validated environmental parameters, is capable of achieving the TrueZero™ specification of incisal pin-return repeatability. The remedy for failure to meet this specification is set out in this Section 11.2 and is the Buyer's sole and exclusive remedy for accuracy-related claims.

Eligibility — all of the following must be true:
(a) The Buyer reports the alleged accuracy failure to info@dacos.dental within 14 calendar days of delivery confirmation;
(b) The Buyer's 3D printer is a model published by Metadac FZE on the validated-printers list (or one for which the Buyer obtained written pre-approval prior to purchase);
(c) The Buyer used a DACOS-validated resin and the exposure profile specified in the DACademy calibration documentation;
(d) The Buyer completed the published TrueZero™ calibration cycle and recorded video evidence of the procedure and the failure;
(e) The Buyer participated in a mandatory live remote verification session with Metadac's technical team.

Verification process:

1. Buyer submits the calibration video and the eligibility checklist to info@dacos.dental;

2. Metadac's technical team reviews the submission within 5 business days and schedules a remote verification session (typically 30 minutes);

3. During the session, the team and the Buyer jointly diagnose the printer settings, articulator condition, resin batch, environmental conditions, and calibration sequence. The session is recorded for both parties' records;

4. Where the joint diagnosis identifies a user-controlled root cause (printer out of specification, articulator drift, incorrect resin, procedure not followed), the claim is closed without refund and remediation guidance is provided. The Buyer may re-attempt and re-submit within additional 10-days window;

The Buyer's failure to provide the required evidence, to use a validated printer, to participate in the verification session, or to follow the published procedures voids the TrueZero™ Accuracy Guarantee.

11.3 Non-Returnable Items

The following are not eligible for return or refund under any subsection:

• Customized, branded, or logo-personalized DACOS components;

• Items damaged by improper handling, storage, installation, or use outside published parameters;

• Items exposed to resins, adhesives, sterilization chemicals, or environmental conditions outside our usage guidelines;

• Items resold or transferred to any third party — the guarantee and return rights are non-transferable;

• Components consumed during use (magnets, adhesives, calibrator STL prints).

11.4 Refund Mechanics

Approved refunds are processed as follows:

• Currency: refunds are issued in US Dollars (USD), matching the original checkout currency;

• Refund method: original payment method only;

• Processing time: within 14 business days of (i) receipt and inspection of the returned product (Section 11.1) or (ii) Metadac's written confirmation of the accuracy guarantee claim (Section 11.2);

• Deductions: return shipping (unless the return is attributable to Metadac under Section 11.1), and any applicable restocking fee disclosed at the time of return authorization;

• Customs duties, import VAT, and local taxes paid in the destination country are not refundable by Metadac FZE. The Buyer is responsible for any recovery through the destination country's authorities;

• Metadac may, at its sole discretion, offer a replacement product in lieu of a monetary refund.

11.5 International Returns

For Buyers outside the United Arab Emirates:

• Return shipping costs are typically comparable to the original carrier rate;

• The Buyer is responsible for proper packaging, export documentation, and any re-entry customs charges;

• Metadac may decline returns where local regulations prohibit the re-import of used dental laboratory components;

• All returns must use trackable courier methods.

11.6 Limitation of Liability

The Buyer's exclusive remedy under Section 11 is limited to (i) repair or replacement of the affected DACOS product, or (ii) refund of the original kit purchase price actually paid to Metadac FZE.

To the maximum extent permitted by applicable law, Metadac FZE shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to: lost dental laboratory revenue, costs of patient or client remakes, loss of professional reputation, lost time or productivity, or any third-party claims — whether based in contract, tort, or otherwise, and even if Metadac was advised of the possibility of such damages.

Some jurisdictions do not permit the exclusion of certain damages. In those jurisdictions, Metadac's liability is limited to the maximum extent permitted by applicable law.

11.7 Anti-Abuse

Metadac reserves the right to deny refund or replacement requests where:

• The Buyer has had two or more prior claims denied for failure to follow published procedures;

• The product was resold, gifted, or transferred to any party other than the original purchaser;

• The claim is determined, in Metadac's reasonable judgment, to be fraudulent, abusive, or made in bad faith;

• The Buyer refuses to participate in the verification process under Section 11.2;

• The Buyer makes public defamatory statements about DACOS or Metadac prior to completing the verification process.

11.8 Force Majeure

Metadac FZE shall not be liable for delay or failure to perform any obligation under this Section 11 caused by events beyond its reasonable control, including but not limited to acts of war, civil unrest, government or regulatory action, embargoes, pandemic, natural disasters, internet or banking disruptions, customs delays, or supplier failures.

11.9 Governing Law and Jurisdiction

Section 11 and any dispute arising from it are governed by the laws of the United Arab Emirates. Disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai. Where this Section 11 is published in languages other than English, the English version prevails in case of conflict.

12. Professional Use Disclaimer

DACOS Omni is designed exclusively for professional use in dental laboratories by trained dental technicians and professionals. It is not intended for direct intraoral application on patients. Correct installation and use requires following the official DACOS setup and calibration procedures. Metadac FZE is not responsible for outcomes resulting from improper installation, use of non-matching offsets, use of incompatible materials, or deviation from the documented workflow.

13. Changes to Terms

We may update these Terms & Conditions from time to time to reflect changes in our operations, products, intellectual property, or legal requirements. The latest version will always be available on dacos.dental. Your continued use of the website and services after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the United Arab Emirates, with primary reference to UAQ Free Zone jurisdiction.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive or non-exclusive jurisdiction of the competent courts of the UAE (including Dubai courts), as applicable.
